Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Bonsai platform, including our website, chat interface, and related services (together, the “Platform”). Please read them carefully. By accessing or using the Platform, you agree to be bound by these Terms.

The Platform is operated by Bonsai (operated by [Company Name] Pte. Ltd., UEN [__________]) (“Bonsai,” “we,” “us,” or “our”), and is offered in partnership with Willy Insurance Brokers ([full legal entity name], UEN [__________]), a licensed insurance broker in Singapore (“Willy”).

1. Acceptance of these Terms

By creating an account, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Platform.

If you are using the Platform on behalf of another person or an organisation, you represent that you are authorised to accept these Terms on their behalf.

2. What Bonsai is

Bonsai is a technology platform. It helps you discover, compare, understand, and arrange travel and motor insurance, and assists you with related tasks such as collecting information for a claim. Bonsai uses automated tools, including AI, to present information and options.

Bonsai only facilitates your insurance journey. Bonsai is not an insurer, does not underwrite policies, does not bind cover, and does not pay claims. Bonsai does not provide financial advice or personal recommendations, and nothing on the Platform should be treated as such.

3. Roles: Bonsai, Willy Insurance Brokers, and insurers

It is important to understand who is responsible for what. Three separate parties may be involved in any insurance you obtain through the Platform:

  • Bonsai (the Platform). Provides the technology that lets you search, compare, and interact with insurance options and manage related tasks. Bonsai’s role is limited to providing the Platform and the information and tools within it.
  • Willy Insurance Brokers (the broker). Insurance offered through the Platform is arranged and distributed by Willy, a licensed insurance broker regulated in Singapore. Willy is responsible for the regulated activity of arranging your insurance in accordance with its regulatory obligations. Nothing in these Terms limits or removes any duty Willy owes to you under applicable law or regulation in connection with that regulated activity.
  • The insurers (the underwriters). Each policy is issued and underwritten by the relevant insurance company. The insurer — not Bonsai and not Willy — is responsible for the terms of your policy, for accepting or declining cover, and for assessing and paying claims. Your insurance contract is between you and the insurer, and is governed by that policy’s own terms, conditions, and exclusions.

4. Eligibility and your account

You must be at least 18 years old and able to enter into a binding contract to use the Platform. You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You are responsible for all activity that occurs under your account.

You agree to provide true, current, and complete information. Insurance decisions and pricing depend on the information you supply; inaccurate or incomplete information may affect your cover, your premium, or an insurer’s decision on a claim.

5. Information only — not financial advice

Content on the Platform — including comparisons, summaries, coverage explanations, quotes, and AI-generated responses — is provided for general information to help you make your own decision. It is not financial advice, a personal recommendation, or an assessment of suitability for your particular circumstances.

The definitive terms of any product are set out in the insurer’s own policy documents. You should read those documents before you commit. Where there is any inconsistency between the Platform and an insurer’s policy documents, the policy documents prevail. Your insurance decisions remain your own.

6. Quotes, pricing, and issuance of cover

Quotes and prices shown on the Platform are indicative and may change, expire, or be subject to the insurer’s acceptance, eligibility criteria, and underwriting. A quote does not constitute cover. Cover only takes effect when the relevant insurer issues the policy and any required premium has been paid and accepted.

We take reasonable steps to present accurate information, but we do not warrant that all product information, availability, or pricing on the Platform is complete, current, or error-free.

7. Payments

Payments made through the Platform are processed by third-party payment providers. By making a payment you agree to the applicable provider’s terms. Premiums, refunds, and cancellations are governed by the relevant insurer’s policy terms and applicable law.

8. The Platform is provided “as is”

To the fullest extent permitted by law, the Platform is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability.

We do not warrant that the Platform will be uninterrupted, timely, secure, or error-free, that automated or AI-generated output will always be accurate or complete, or that defects will be corrected. You are responsible for verifying important information against the insurer’s policy documents before relying on it.

9. Limitation of liability

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law. In particular, nothing here excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that Singapore law does not permit to be excluded (including under the Unfair Contract Terms Act).

Subject to the paragraph above, and to the fullest extent permitted by law:

  • neither Bonsai nor Willy Insurance Brokers is liable for any loss or damage arising out of or in connection with your use of, or inability to use, the Platform, including any loss arising from reliance on information, comparisons, or AI-generated output presented by the Platform, or from any interruption, error, delay, or unavailability of the Platform;
  • neither party is liable for any indirect, incidental, special, consequential, or punitive loss, or for any loss of profits, revenue, goodwill, data, or anticipated savings, however arising; and
  • each party’s total aggregate liability arising out of or in connection with the Platform and these Terms is limited to [S$100 / the amount you paid to Bonsai in the 12 months before the claim, whichever is greater].

For clarity, this section limits liability relating to the Platform. It does not affect, and is separate from: (a) the regulatory duties Willy owes you as a licensed broker in connection with arranging your insurance; and (b) the insurer’s obligations under your policy. Claims relating to your insurance cover are a matter between you and the relevant insurer (and, where applicable, Willy) under the policy terms and applicable law.

10. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Bonsai and Willy from and against any claims, losses, liabilities, and reasonable expenses arising out of your breach of these Terms, your misuse of the Platform, or your provision of inaccurate or misleading information.

11. Intellectual property

The Platform, including its software, design, text, and branding, is owned by Bonsai or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, reverse engineer, or create derivative works from the Platform except as permitted by law.

12. Acceptable use

You agree not to misuse the Platform, including by attempting to gain unauthorised access, interfering with its operation or security, submitting false information, using it for any unlawful or fraudulent purpose, or using automated means to extract data except as we expressly permit.

13. Data protection and privacy

We handle your personal data in accordance with our Privacy Policy and Singapore’s Personal Data Protection Act (PDPA). By using the Platform, you consent to the collection, use, and disclosure of your personal data as described in the Privacy Policy, including sharing information with Willy and the relevant insurers as necessary to provide quotes, arrange cover, and process claims.

14. Third-party services

The Platform may rely on or link to third-party services, including insurers, brokers, and payment providers. We are not responsible for the content, products, or practices of those third parties, and your dealings with them may be subject to their own terms.

15. Changes to the Platform or Terms

We may update the Platform and these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

16. Governing law and dispute resolution

These Terms are governed by the laws of Singapore. Subject to any mandatory rights you have as a consumer, you and we submit to the exclusive jurisdiction of the courts of Singapore in respect of any dispute arising out of or in connection with these Terms or the Platform.
